Pakistan: Fixing the civil-military imbalance

Sovereignty is the flavour of the month in Pakistan. Since the capture and questionable assassination of Osama Bin Laden, the Pakistani discourse has been dominated by endless references to national sovereignty, honour, defence and pride. This jolt to the Pakistani state of mind has come at a time when media is relatively free, a vibrant boundless Internet flashes news by the second and there is quasi-democracy straddling between opportunism of the political elites and tunnel visions of the permanent ruling class: the security establishment.

That the Americans would conduct a surgical strike in the heart of military complex and ‘eliminate’ the poster-boy of Islamism has perturbed the right wing and their patrons who had worked hard for decades to construct a xenophobic, paranoid mindset justifying the country’s military machine. Arguments on incompetence or complicity are lethal for the uber-nationalist narratives; and hence the dilemma, perhaps the greatest of crises for the right wing in Pakistan. (more…)

The killing of Osama bin Laden is another hurdle to tackle, and we are in a critical moment of another reevaluation of the Pakistan-US relations, just a few months after the close of the Raymond Davis saga.

Pakistan-US relations are subject to global scrutiny and elude a definitive assessment due to the nature of a partnership scarred by history, competing interests and unflattering public opinion. Recent surveys such as the BBC World Service Poll indicate that most Westerners perceive Pakistan negatively, while opinion polls, such as the PEW in Pakistan, confirm that the US is neither trusted nor liked by a sizeable majority of its citizens. In this game the media can play the role of a mediator of sorts and allow for the flexibility to overcome the explosive faultlines — both literally and figuratively — between the two countries. As details of Operation Geronimo unfold, more and more questions are being raised regarding Pakistan’s role in the war on terror. Sadly, millions of Pakistanis are even more confused than the global pundits. Other than the lunatic fringe thriving in the folds of mainstream media, ordinary Pakistanis are dumbfounded at the prospect of the world’s most wanted man living next to the deep state’s power-house, i.e., the Pakistan military academy. If bin Laden was indeed residing in a purpose-built house with extra thick walls and security cameras then how come Pakistan’s most ‘efficient’ institution was unaware of this lethal presence? Furthermore, if they were not involved in the operation then how could a mammoth defence establishment allow such a clandestine operation by a foreign country which violated air space and international laws?

Governance crisis: Some of these questions will be answered in due course and some will perhaps turn into eternal conundrums. Perhaps, the most pressing issue then remains, who governs Pakistan and in what manner? Seemingly a constitutional republic, Pakistan’s representative and relatively accountable institutions surely do not steer the ‘national security’ policies. The latter have their own limitations and imperatives of rent-seeking but they are marginal to core policies. Osama Bin Laden is dead: what next for Pakistan?

The dramatic events of May 2, enacted in Pakistan’s small, sleepy town of Abbottabad have surely shaken the world. The global icon of al Qaeda — Osama bin Laden — has been ‘eliminated’ through a well-executed, covert operation. This was a major victory for charismatic US president Barack Obama especially given his dwindling popularity, and will help him survive in office, perhaps, for another term. It isunlikely that this development will lead to the end of global terrorism. While his death may have symbolic value, Osama was not in any case in charge of al Qaeda operations and hence the impact may not be much.

The most significant aspect of this game-changing event, perhaps, is the cutting of all ties between al Qaeda and sections of our security establishment. While Pakistan’s assistance in executing the operation against bin Laden’s hideout is being downplayed for political reasons, it should be obvious that all this couldn’t have happened without its active help. For all its front line status, the Pakistani state has not yet permitted the Americans to operate in the ‘settled’ areas, the way unmanned drones work in Fata. The recent hullabaloo over the strained Pakistan-America relationship has once again proved to be exaggerated: Stories were spun for domestic political consumption in both countries. (more…)

‘Reforming’ the education system

The recent debates on education have also highlighted how the education sector is not receiving its due compared to say defence, infrastructure and other expenditures made by the government. However, the discussion has yet to move to the most important area i.e. quality of schools and what sort of learning are they providing?

The task of reforming the education system is huge, complex and some would say next to impossible. However, the 18th Amendment to the Constitution has opened the doors to avenues for change. Firstly, education is a provincial subject and the transfer of budgets (with increased allocations through the National Finance Commission Awards) implies that there is now more flexibility and autonomy with the provinces in matters of policy and operations. Secondly, the inclusion of right to education in the fundamental rights also ensures that this is now a justiciable right as well as a paramount priority of the state. (more…)

The impediments to full provincial autonomy under the 18th Amendment need to be tackled despite the odds

Perhaps the best thing about contemporary Pakistan is the way its governance arrangements are being restructured to undo the bitter, brutal legacy of centralisation. Had we undertaken such reform decades ago, Pakistan would have been a far better place. The 18th Amendment reflects a board political consensus on how Pakistan can actually evolve into a real federal state as opposed to the notional federalism of the past where provincial autonomy had become a residue of central patronage and not guaranteed by the Constitution.

Nevertheless, the devolution of powers in 2011 faces two major dilemmas. First, the provinces are currently operating as centralised bureaucratic apparatuses with little or no powers and accountabilities at the local levels. Second, and perhaps far more important, the provinces have to build their technical and political capacities to handle the new powers and functions, which are now flowing at an unprecedented speed. These two challenges are the real test of civilian governments and it remains to be seen if they can handle it lest another messiah or messiah-proxies enter the arena and reverse this process. Knowing Pakistan’s history, anything is possible. This is a country plagued by lack of political stability and policy continuity. We shall examine the pitfalls and challenges that lie ahead in this transitional process.

Progress so far: During the first two phases of the devolution, 10 of the 48 ministries at the federal level were to be devolved. The Committee set June 30th 2011 as the deadline for this process. Taking up these recommendations, the federal cabinet devolved ministries for special initiatives, Zakat and Ushr, population welfare, youth affairs, and local government and rural development to the provinces in December 2010. The provinces also inherited office buildings, equipment, development funds and projects for fiscal year 2010-11. All international matters of these ministries were transferred to the Economic Affairs Division (EAD) and some planning-related matters to the Planning and Development Division. However, overall planning of ministries that are being transferred or will be transferred in February 2011 will be the responsibility of provincial governments.

On April 5th, 2011 the second phase of the devolution process commenced, with the devolution of the ministries for education, social welfare, and special education, tourism, livestock and dairy, rural development and culture. According to reports, the Commission for Implementation of the 18th Amendment has also approved a plan for the transfer of three federal ministries, including sports, women development and environment, to the provinces in the third phase.

Unclear federal arrangements: While the centre has abolished ten ministries so far, there is a deadlock over the staff and resources. Provinces complain that they cannot pay the wage bill of surplus staff and centre has retained all the existing federal public servants, as any move to right size will be fraught with political dangers. Similarly, after June 2011, who will pay the staff? If the federal government continues to foot the salaries bill then it will not be able to rationalise its size and the temptation of recentralisation will remain. Secondly, the federal government’s move to shift attached bodies and autonomous organisations to Cabinet Division and such other dysfunctional ministries is even worse. There needs to be a more thorough assessment of post-devolution architecture of the central authority. An amended, rationalised HEC needs to stay in place

The 18th Amendment approved by the Parliament in 2010 signified a new era in Pakistan’s troubled federalism. Given our turbulent constitutional history, the new governance arrangements approved by all parties and federating units settled for a leaner centre and addressed long-standing demands of provincial autonomy. But the implementation of this amendment has been slower than expected, largely for reasons of capacity both at the federal and provincial levels. Despite the constraints, the Implementation Commission has delivered fairly well. Thus far, ten ministries have been devolved. Five ministries — local government, special initiatives, zakat & ushr, population welfare and youth affairs — were devolved in late December 2010. The recent batch of the federal ministries includes: ministries of education, social welfare and special education, Tourism, livestock and dairy and culture.

Media rants:

In recent days, a new controversy on the devolution of the Higher Education Commission (HEC) has plagued the implementation process with respect to the 18th Amendment. Television channels have aired the views of technical experts as well as the usual suspects who rant on every talk show on almost every subject under the sun, be it defence, culture, or cricket. The move towards the devolution of the HEC’s powers and functions to provinces has been construed as another move by the semi-literate and ‘corrupt’ politicians to thwart the degree validation process, which has been part of our pseudo political discourse. Such an argument is pretty lame, as the rule to have a degree to be eligible for an election has been done away with. The Musharraf scheme of a grand HEC, BA-holding legislators and ‘controlled democracy’ obviously failed in 2008 when the electorate rejected his party and sent representatives who sent him home. Balochistan: Pushed to the wall

There must be something terribly wrong with the state of Pakistan that in its largest province, state schools no longer recite the national anthem and are giving up on the Pakistani flag. Tragic, that such alarming reports flashed in the national newspapers and on the internet are a subject of little debate and introspection across the country. Either that nobody really cares as to what happens to the tribals in the southwest of Pakistan, or that there is soft censorship at play. Such is the level of self-censorship on the issue of Balochistan that the ongoing insurgency finds scant mention in the otherwise, hysterical electronic media of Pakistan. True, there are brave exceptions in the public arena, but the eerie silence on Balochistan is disturbing for any Pakistani who believes in the territorial and federal integrity of Pakistan.

Only during the last six months, dozens of Baloch political activists have been reported dead. It is difficult to ascertain exact numbers, given the lack of credible information. But palpable violence defines the state of Balochistan. On the one hand, there are Baloch activists, leaders and professionals who are being targeted by ‘unknown’ forces and on the other hand, thousands of ‘settlers’ (mostly Punjabis) have been leaving the province, as their lives are no longer secure. A wide array of Baloch separatist groups exist in the province, whose source of funding is unknown and whose political agenda is vague, despite the overall banner of ‘independence’. (more…)

Civil versus political society

Several self-styled analysts on ‘civil society’ have articulated contrarian views about the kind of choices they face, particularly with respect to forging alliances with political parties and avoiding the vigilantism that is the preserve of the extremists. The lawyers’ movement is being repeatedly cited as reference point without much introspection. Save a few exceptions, one is yet to hear a forceful condemnation of Islamabad lawyers’ love for Qadri.

We are faced with a deeper challenge today: Surviving as a plural society against a sectarian tide getting out of control. This is why engaging with the ‘political society’ is all the more important. We know that moderate parties such as the PPP are reticent to mobilise the cadres against extremism. Hence, the need to pressurise them into taking action to re-establish state writ. Condemning the PPP, the MQM, and the ANP may be the easiest recourse for many analysts but the truth is that we cannot work in isolation. No agenda for change, unless mullahs and the unelected saviours articulate it, is possible without the support of political society and grassroots cadres of political workers.

Pakistan’s political society is admittedly polarised on the issue of extremism.The state and its proxies have indoctrinated millions in the recent decades. Yet, Pakistanis have instinctively rejected their brand of societal framework, governed in part by the dictates of modernity and economics. A large number of students in Pakistan’s major universities are women who are increasingly visible in the workforce. There is a wider constituency in Pakistan, which is integrating into a global information economy and disagrees with the opportunist mullahs. This trend is likely to be irreversible.

The pejorative use of the term ‘liberal’ is also problematic for it is something not rooted in our historical trajectories of socio-economic development. It has captured the phony discourse by its misuse. Thus we have witnessed the emergence of a disparaging term, ‘liberal fascist’. Instead of fighting on this false binary of liberal-vs-conservative, we may have to get back to the essential question of seeking tolerance in a society scarred by violence, marginalisation and sectarianism.

Within the civil society debates, monitoring hate speech has been termed as mirror vigilantism. Again, this is a spurious argument for the extremists are killing people and there is no space for incitement to violence under the laws of our land including the Islamic laws that have been blended into our legal system.

Therefore a new agenda has to emerge in this existential battle for Pakistan. There is no alternative for the miniscule cadre of ‘civil society’ activists to engage with political parties, labour groups, moderate ulema and other professional associations to rally around the agenda for moderation. Without the involvement of political workers, the vigils and rallies of concerned citizens will remain footnotes in the tragic history of Pakistan. In any case a civil society is meaningless if not engaged with the larger citizenry.

Before it’s too late

As Pakistan enters into another year fraught with fresh challenges and old dilemmas, it is quite clear that its ruling elites – civil and military – are unwilling to learn from history. The crisis of governance in the country has spiraled out of control. We are heading towards grave internal conflict, the possibility of which has been bolstered by serious economic woes in the wake of high inflationary trends. Most importantly, the dilemma of reconciling our national security interest with a possible long-term economic agenda is becoming even more problematic by the day.

Radicalistan? Pakistan’s radicalization is now a threat to its society and the region. Whilst General Zia ul Haq will be remembered for institutionalizing extremism, most Pakistani governments, including democratic and quasi-democratic regimes have in the past, surrendered to the Islamist fringe. From Liaquat Ali Khan’s acquiescence to a terribly vague and confusing Objectives Resolution to Zulfikar Ali Bhutto’s unforgivable act of declaring Ahmedis as non-Muslims through a constitutional amendment, Pakistan’s long-term interest has always been sacrificed at the altar of short-term expediency and political survival. But the Pakistan of today is not a case of a majority beholden to a virulent minority; it is split from within and fraying at the edges.

Extremism has become embedded in our social fabric?: we are a country in transition. The old is cracking up and the new remains undefined and directionless. Over 65 percent of Pakistan’s exploding population is under the age of 26 and the coming generations will set the future course of the country. However, the portents are disheartening. Nearly 60 percent of youth surveyed in a countrywide poll (organized by British Council Pakistan) had little faith in democracy. Therefore, the glorification of former Governor Punjab Salmaan Taseer Shaheed’s murderer is not an isolated incident. It reflects a combination of societal changes in the broader context of religo-political transformation. At least three factors have greatly contributed to these phenomena.

First, the education system and its overtly pro-jihad bias (whether in madrassas or in state-run schools), has led to the construction of a particular mindset that shuns reason in favor of a theological or a hyper-nationalist discourse. Second, the institutionalization of mullahs and mosques with hefty state patronage backed by the zakat distribution systems ensure that public discourse is controlled and aligned with national security imperatives. Third, the sheer neglect of a social change agenda and absolute disregard for issues of social justice and a citizen voice means that there is an ever-increasing citizenship crisis. A large number of Pakistanis either enjoy partial citizenship rights (Balochistan, many parts of Khyber-Pakhtunkhwa and even Karachi for that matter) or none at all (Federally Administered Tribal Areas, Azad Jammu and Kashmir to name a few). Our ‘brotherly’ friends

Thanks to sensational reporting on WikiLeaks, the relationship of Pakistan with Saudi Arabia has been spotlighted. We have known of ideological links between radical Islamic groups and their Saudi patrons for a long time. However, this has never been debated due to the status the Saudi monarchy enjoys in Pakistan. Criticising it constitutes sacrilege and the moment one even begins to raise a question, the proponents of the ‘warm’ and ‘time-tested brotherly ties’ construe this as an attack on Islam. Let’s be clear: The House of Saud is a temporal, political entity and is not representative of spiritual Islam.

Wikileaks and Pakistan

The WikiLeaks saga has reconfirmed the status of Pakistan as a client state. Its leadership — civilian and military — as a matter of routine, involves external actors in matters of domestic policy and power plays. We knew this all along but the semblance of documentary evidence confirms the unfortunate trends embedded in Pakistan governance systems. However, the orthodoxy that it is the West which interferes is not the full story. The inordinate influence exercised by ‘friendly’ Arab states, especially Saudi Arabia, is also a sad reminder of how warped Pakistan’s way of living is.

India is the principal enemy; and our Saudi and Gulf friends wish the other neighbour, Iran, to be bombed. We are obsessed with “legitimate” security interests in Afghanistan. This is a dysfunctional state of being and has made us addicted to western aid, leveraging global great games and denying that regional cooperation is in our ultimate self-interest. Such delusional ways of looking at the world has made the state splinter and devolve authority to non-state actors, which can advance its security policies. (more…)

The recent decision of the federal cabinet to rationalise General Sales Tax (GST) and levy a one-time flood surcharge are much-needed reforms to bolster Pakistan’s elusive and perhaps unattainable ideal of economic self-reliance. A state, which has perfected the art of collecting and negotiating rents for its strategic games, is least interested in creating a redistributive welfare state.

The emergence and fortification of a rentier state, therefore, is neither peculiar nor new as phenomena. However, it has now come to haunt the future of the country due to the evolution of rent-seeking culture, which is almost a way of life. We need no half-baked perceptions-based studies from abroad to know that crude and sophisticated forms of corruption are now embedded in our public life. From the delivery of a basic service to the purchase of a submarine, this is the way the country functions. The elites have strengthened trends such as tax-evasion and made them legit mechanisms of governance and public affairs. (more…)

Asma Jahangir – A formidable fighter

Fearless and a formidable fighter, Asma Jahangir personifies the struggles Pakistanis have initiated against shameful cultural practices, discriminatory legislation and executive excess. A frail woman has kept the torch of public liberties, freedom and democracy alive for decades. Born on January 27, 1952, in Karachi, Asma Jahangir during the last forty years has become a champion of women, child and minority rights and in many ways the conscience of Pakistan.

A leading Pakistani lawyer and an advocate of the Supreme Court of Pakistan, Jahangir is most renowned for her role as a human rights activist, a role which has made her confront military dictatorships of General Zia-ul-Haq and General Pervez Musharraf and the civilian autocrats. In 1972, Asma Jahangir was only 18 when she filed her first petition to have her father — who had been arrested for denouncing the genocide in Bangladesh — released from prison. In a landmark judgment ten years later, she won the case. In fact, the earliest and perhaps the only judgment against a military coup is now attributed to her name. An agenda that does not deliver

South Asia is a region marked for its turbulent history and its endemic poverty and misgovernance. Much has been written about how certain states in India are worse off than Sub Saharan Africa in terms of social and economic indicators. Or that Pakistan and Bangladesh have millions of people struggling for a meager income to keep their families alive. The truth is that despite the recent gains made in economic growth in most South Asian economies, the structural causes of poverty persist and haunt the national planners.

The World Bank, or the rather grandiose title – the Bank – has remained a major player in the South Asian economies aiming to help these countries in reducing poverty and enhancing economic growth. The Bank has gained more traction in countries such as Pakistan and Bangladesh where the unelected executive is eager to engage with the IFIs and decisions on lending are achieved quickly. India has remained engaged but its complexity and federalism makes transactions more intensive. Having said that the country has emerged as World Bank’s favorite in the recent years. For instance, the Bank, committed USD 9.3 billion in financial assistance to India in the 2009-10 fiscal, more than the aid committed by the U.S. and the European Union. Although this is a small sum for India’s U.S. $1.2 trillion economy, it represents a sharp increase from the U.S. $2.2bn lent to India by the Bank last year  – Bank lending to India has traditionally averaged about U.S. $2.5-3bn a year. Similarly, for Pakistan the average lending level has been around $1-2bn, this has increased lately due to the recent recession and food and energy shocks. (more…)
